Louisiana Adoption Lawyer on Private Adoption

A private adoption is when the adoptive parent(s) and the biological parent(s) have no familial relationship. It is an arrangement between the adoptive parent(s) and the biological parent(s). Private adoptions normally require a contract between both sets of parents detailing issues such as how much of the biological parents’ expenses must be paid for. A common example is when the adoptive parent(s) agree to pay for all of the hospital expenses related to child birth. Harold E. Weiser, III, is a Louisiana adoption lawyer in the New Orleans Metro Area who has experience in drafting and executing such contracts. The Weiser Law Firm has experienced Louisiana adoption lawyers available for free phone consultations at 504-358-2273.

Louisiana Adoption Lawyer on Intrafamily Adoptions

An intrafamily adoption occurs between family relatives and is sometimes referred as the “stepparent adoption.” The aforementioned allows stepparents to adopt their spouse’s children. Intrafamily adoptions also applies uncles, aunts, first cousins, grandparents, step-grandparent, or other family member to the twelfth degree, if the following conditions are met:

  1. The prospective parent is related to the child by blood, adoption, or affinity through a parent who has parental rights.
  2. The future parent is a single person over the age of 18 or a married person whose spouse is a joint petitioner.
  3. The prospective parent has had legal and/or physical custody of the child for at least six months prior to the filing of the petition.

The adoptive parents in an intrafamily adoption may be subject to a home study and a background check for a history of criminal activity and child abuse or neglect and a host of other ‘red tape.’ You will need an experienced Louisiana adoption lawyer to help you navigate your adoption matter.
